spore — Terms of Service
Last updated 2026-10-02. These terms have not been reviewed by a lawyer; they say what we actually do.
These terms are between Newnorm Inc., a federal corporation carrying on business as wemark ("wemark", "we", "us"), and the dental practice that uses spore ("the practice", "you").
By creating a spore account or using spore, the practice accepts these terms. If you are accepting on behalf of a practice, you confirm you are allowed to.
1. What spore is, and what it is not
spore is a record. It records what your practice does when it sterilizes instruments: which machine ran which load, when, who packed it, who signed it out, what monitoring tests were run and what they said, and where each pouch was opened.
What spore does not do, and you should not rely on it to do:
- It does not sterilize anything, and it does not verify that anything was sterilized. It records what your staff and your machines report.
- It does not inspect, test or certify your autoclave.
- It does not decide whether a load passed. A person does that, and spore records who.
- It does not make your practice compliant with any law, regulation, college standard or inspection. Whether your practice meets its obligations depends on what your practice does, not on what software it uses.
- No regulator has approved, certified or endorsed spore. It is not a medical device and is not sold as one.
Keeping good records is your obligation. spore is a tool for keeping them.
2. Your account and your people
The practice is responsible for who it lets in. Staff sign into the steri-room screen with a 4-digit PIN rather than an account, so a PIN identifies a person in the record: treat PINs as you would a signature. Tell us promptly if you think an account, PIN or device has been compromised.
You will not share one login between people who should be identifiable separately. The value of the record is that it says who.
What you agree not to do with spore:
- Enter patient names, chart numbers, health card numbers or clinical notes. spore has no field for them on purpose. If you put a patient identifier into a free-text field anyway, you take on whatever obligations that creates.
- Try to break into it, probe it for weaknesses, or interfere with it.
- Copy it, reverse engineer it, or resell it or offer it to other practices as a service without our written agreement.
- Use it for anything unlawful.
If you do any of these we may suspend your account while we sort it out.
3. Your records belong to you
Everything your practice puts into spore, and everything spore derives from it, is the practice's. We do not own it and we do not sell it.
We hold it to provide spore to you, to keep it safe, and to support you when you ask. We may use aggregated, de-identified information that cannot identify a practice, a person or a patient to operate and improve the service.
You can export the whole record at any time, as a PDF report or a data export, without asking us.
Nothing in spore deletes a sterilization record. Not you, not us, not through the app. Corrections are added as new entries; earlier entries remain. That is deliberate: a record you can quietly edit is not evidence.
4. What we charge, and when
Prices are as published at usespore.com, plus applicable taxes (HST in Ontario).
- Free trial: 30 days.
- Monthly: billed monthly, cancel effective at the end of the current month.
- Annual: billed annually.
- 3-year: billed annually at a discounted rate, for a three-year term.
If you cancel an annual or 3-year plan early, you pay for the months you used at the regular monthly price, and we refund the rest of what you prepaid. You keep nothing you did not use and you owe nothing for months you will not use; you only give back the discount on the months you had. We will send the calculation with the refund.
wemark sends your invoice, each month or as agreed for a committed plan. You pay it by pre-authorized bank debit or e-Transfer; bank debits are processed by Stripe, and we never see or store your bank numbers.
If an invoice goes unpaid, we will tell you and ask. Section 6 says what happens if it stays unpaid.
We may change prices with 60 days' notice. A change does not affect a committed term already running.
5. What we will do
We will provide spore with reasonable care and skill, keep your records as described in the Privacy Policy, and tell you without undue delay if we become aware that your records have been exposed.
We do not guarantee that spore will always be available. It depends on the internet, on your clinic's network, on your hardware and on suppliers we do not control. The steri-room app keeps working offline and syncs when the connection returns, but that is a mitigation, not a promise of uptime. If you need a record to exist regardless of our service, export it.
We will give you 30 days' notice before removing a feature you rely on, and we will not make your existing records unreadable.
6. If you stop paying
Counted from the day an invoice falls due:
- For the first 14 days, nothing changes. The app tells you the invoice is overdue.
- From day 15, the office side locks: adding machines, staff, pouch types and invitations. The steri room keeps working, and the app counts down to day 30.
- After 30 days unpaid, spore is suspended: no new loads, labels or pouch scans until the invoice is paid. If your plan ends, the same applies.
Even when suspended:
- You can always read and export every record you have ever made. Your records are yours, and an inspector may ask for them.
- A load already in the sterilizer can still be unloaded and its result recorded, an indicator already incubating can still be read, and a failure can always be reported. Those finish a safety record already started.
- Anything your devices recorded while offline before the suspension began is still saved.
Paying the invoice restores everything at once. We would rather talk than suspend: write to spore@wemark.ca as soon as something is wrong.
7. Ending it
You may cancel at any time, subject to any committed term (section 4). Cancel from Settings or by telling us.
We may suspend or end your account if you use spore unlawfully, if you do not pay after we have asked and waited, or if we stop offering spore — in which case we will give you 90 days' notice and help you export everything.
After cancellation, your records stay readable and exportable in spore for 12 months. After that we close the account, and your staff and account details are deleted as described in the Privacy Policy. The sterilization records themselves are kept for 10 years after cancellation and we will give you a complete export of them at any time in that period if you ask. A practice inspected three years after leaving spore should not be stranded. If you ask us to delete the records sooner, we will, and we will confirm in writing when it is done.
Export before you go anyway. It is your record; keep a copy where your practice, your insurer or your regulator expects one.
8. Limits
To the extent the law allows, our total liability for any claim relating to spore is limited to the fees you paid us in the 12 months before the claim, or $100 if you paid nothing in that period. We are not liable for indirect or consequential loss, loss of profit, or loss of reputation.
We keep your records with care and we back them up as the Privacy Policy describes. We do not promise that data can never be lost, and we are not liable for the consequences of spore being your only copy: export and keep your own.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Consumer protection legislation may give you rights these terms cannot take away.
Except as stated in these terms, spore is provided as it is, without other warranties.
If a claim is brought against us because of what your practice put into spore, because you entered patient identifiers we told you not to, or because of how your staff used it, you will cover our reasonable costs of dealing with it.
9. Confidentiality
Each of us will keep the other's confidential information confidential, and use it only for spore. Your records are your confidential information.
10. Changes to these terms
We may update these terms. If a change materially affects you, we will tell you at least 30 days before it takes effect, by email to your account's owner. Continuing to use spore after that means you accept it. If you do not, you may cancel and we will refund any fees covering the period after cancellation.
11. Law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction.
If part of these terms turns out to be unenforceable, the rest still stands. If we do not enforce something once, we have not given it up. You may not hand these terms to someone else without our agreement; we may, if wemark is sold or merged, and we will tell you. These terms and the Privacy Policy are the whole agreement about spore. Sections 3, 8, 9 and 11 survive the end of it.
spore, wemark and their logos are ours. If you send us suggestions we may use them without owing you anything.
